Thanks for posting that link. That explains a bit better. But I think that only the newer systems are ESA'ed.

I'm not sure exactly how it works. I think it depends on if the publisher wants their old games protected. All newer games that are still commerically available are protected; but old games such as all mario & zelda games, even on the NES, are also protected by the ESA.
